Accidents Involving Snow & Ice
The UK is suffering the worst spell of cold weather in 30 years and the bad weather has had a devastating effect on our roads and pavements.

There has been sharp increase in the number of road traffic accidents and falls on snow and ice over the past few days and it is expected that there will be a flurry of compensation claims due to such accidents.

If anyone has been unfortunate enough to have been hurt due to an accident caused by the bad weather and wish to make a claim for compensation then they need to show that it was caused by the fault of someone else. For instance if you have been hit by another car which has skidded into you then you can claim compensation as the other driver has failed to control their car properly.

If you have fallen on ice on a pavement then a claim would have to be made against the local authority. To succeed you would have to show that the council had failed to maintain the area properly. Councils have finite resources and for a claim to succeed you have to show that they had acted unreasonably in failing to maintain that particular area.

If you have fallen on private property, such as a workplace, car park or supermarket because it has not been properly gritted then the claim would be against the owner and occupier of that property. These claims are much more likely to succeed than claims against local authorities.

Our main roads and motorways are under the control of the Highways Agency but the vast majority of our roads are under the control of our local authorities.
